This paper focuses on the Human Rights (Parliamentary Scrutiny) Act 2011 (Cth) and its possible consequences for judicial (rights) interpretation at common law, in particular the principle of legality and the principle that legislation should be construed to be consistent with international law. In the aftermath of Momcilovic, the paper considers more generally how rights are best protected in Australia's constitutional system.
