The High Court’s decision last year in McCloy v New South Wales is one of the most significant constitutional cases of recent years. The case reframed the Lange test for breach of the implied freedom of political communication, introducing a structured proportionality test incorporating concepts from European human rights law. In this seminar, Anne and Damian will discuss the nature of proportionality reasoning, the approaches taken by the various members of the High Court in McCloy, and the implications of the decision.
